Michael Crist Recognized by DRI’s The Voice

Michael Crist was recognized by DRI’s The Voice for having won a motion for summary judgment in Virginia. The defense in this product liability case involved a panoply of attacks upon the Plaintiff’s allegations of product use, but also incorporated a complicated legal analysis of the implications of over a 100 years of corporate sales, transactions, and mergers of multiple entities. Trial graphics traced the lineage of each corporation and the legal effect of each transaction upon the potential successor liabilities of the named defendants. Daniela Abratt to Coach FIU Moot Court Team at Price International Media Law Moot Court Competition

Daniela Abratt, an Associate at DLD Lawyers’ Coral Gables office, has been selected to serve as a coach for the Florida International University College of Law moot court team at the Price International Media Law Moot Court Competition. Ms. Abratt will help the six-student team prepare for oral arguments at the regional round in New York City, where they will compete against teams from across the United States, Caribbean, and Latin America. If the team advances out of the regional round, they will travel to the University of Oxford, United Kingdom to compete in the international round against teams from countries across the globe, including India, the Phillippines, Egypt, Ukraine, and Nigeria.

When Ms. Abratt was a third-year law student at FIU, she participated in this competition and argued as a finalist in the regional competition in New York. She and her team then advanced to the international round in Oxford where they placed third overall out of 35 teams.

The goal of this competition is "to foster and cultivate interest in freedom of expression issues and the role of the media and information technologies in societies around the world." This year’s case involves issues of political expression and laws that limit such expression, protests, and the power of social media as to a tool to disseminate speech. The students will argue before a distinguished panel of lawyers, judges, academics, and practictioners from the media industry.

Jose Rojas and Angel Castillo Defeat Legal Malpractice Claim

JOSE I. ROJAS, a partner at DLD Lawyers, along with Partner, Angel Castillo, represented a prominent Miami attorney and his law firm in defending a lawsuit alleging legal malpractice filed by a former client, a real estate developer, and its two principals, whose business dealings went sour in South Florida during the Great Recession. The lawsuit, potentially for millions of dollars in damages, was filed in the Florida state circuit court in Miami in 2015. The matter was dismissed with prejudice, resulting in a complete win for the client at the trial court level. In the aftermath of the passing of Janet Reno, November 7, 2016, the Daily Business Review published a commentary written by Firm partner, Gregory Victor, along with his fellow former prosecutor, George Yoss, which discusses the virtues of Janet Reno and the many challenges and successes of her tenure as Miami-Dade County State Attorney during the highly volatile and crime-ridden period of the late 1970s and 1980s.

Defense Win in Virginia

Michael James Crist, a partner at DLD Lawyers in Fort Lauderdale, successfully argued a motion for summary judgment in a mesothelioma case pending in Virginia. The Plaintiff claimed exposure to crocidolite (asbestos) products allegedly sold or distributed by the Defendants in 1973. The defense pursued several avenues including the location and deposition of multiple coworkers, the examination of construction records, and collection and analysis of corporate records from multiple sources.

Ultimately, it was the later that proved most effective at the motion stage. Through an extended analysis of over 60-years of mergers, acquisitions, asset sales, names changes, and corporate transactions, he was able to establish through both direct and secondary sources that his client bore no legal responsibility for actions of the company identified in depositions. To untangle the corporate web of historical transactions, thousands of pages of ancient records were summarized, referenced, and explained in a graphic manner. One expanded chart showed every corporate transaction, its evidentiary basis, and its legal effect on the transfer of liabilities. The second chart streamlined and simplified the first chart, showing just the resulting lines of corporate succession and liability. The combination of charts helped to make the confounding, clear, and the complex, simple.

This victory followed his successful arguments before the Georgia Court of Appeals (Fletcher v Water Applications) on an issue of first impression in a take-home asbestos case.

Michael Crist is a partner at DLD in Florida, but handles cases nationally for multiple clients in asbestos, products liability, and general litigation matters.

Defense Win

DLD Lawyers represented a prominent Miami attorney and his law firm in defending a lawsuit alleging legal malpractice filed by a former client, a real estate developer and its two principals whose business dealings went sour in South Florida. The lawsuit, potentially for millions of dollars in damages, was filed in the Florida state circuit court in Miami in 2015. We filed a motion to dismiss the plaintiffs’ Complaint and, after oral argument, the Circuit Judge granted our motion. The judge allowed the plaintiffs an opportunity to correct their pleading defects by filing an Amended Complaint. Thereafter, the plaintiffs filed an Amended Complaint, this time attaching over 100 pages of documentary exhibits. Again we moved to dismiss. At a lengthy hearing held in late August, 2016, the Judge concluded that the allegations of the pleadings and the exhibits attached did not provide any basis to claim that our clients had committed legal malpractice or done anything wrong, and that any economic damages suffered by the plaintiffs had been “self-inflicted.” The Judge granted our motion to dismiss the Amended Complaint, this time with prejudice, meaning that the plaintiffs can not try to amend their pleading again. The judge said that in his view it would be futile for plaintiffs to try to file another amended complaint. Partners, Jose I. Rojas and Angel Castillo, Jr., represented the defendant in this win.

NAMWOLF Business Conference, New Orleans

On February 22, 2016, Jeanne Crandall chaired two panels sponsored by the NAMWOLF Financial Services Practice Area Committee in the NAMWOLF New Orleans Business Conference. The first panel addressed the highly controversial “Fiduciary Rule” now adopted by the Department of Labor which applies to more than $3 million in retirement assets. This rule requires brokers, investment advisers, and others who “recommend” investments for retirement accounts to act in the best interests of their clients and disclose all conflicts of interest (such as higher fees and commissions on certain products) when recommending investments. Previously, IRA accounts were not covered by any fiduciary rule.

Jeanne also moderated the panel discussion on “ E-Discovery in light of the December 1, 2015 Amendments to the Federal Rules of Civil Procedure.” The amendments are a significant change from previous rules applicable in federal court.

Multi-Million Dollar Claim Defeated at Trial

Bill McCue, working with counsel for co-defendants, recently defeated a multi-million dollar claim at trial involving a motorcyclist who crashed into a utility box in the median area controlled by the Florida Department of Traffic and owned and maintained by the Florida Keys Aqueduct Authority. The plaintiff, who suffered permanent brain injuries, alleged that the utility box was improperly raised off the ground and sought recovery from several parties, including the contractor that built the utility box, the company that inspected it and our client, TSI, which was responsible for maintaining the median and the area surrounding the utility box. Plaintiff sought over $14 million from all defendants, and after a four-week trial and only 30 minutes of deliberation, the jury returned a defense verdict.

DLD Lawyers is pleased to welcome Daniela Abratt to the firm.

Ms. Abratt is a recent Florida International University College of Law graduate, cum laude. During law school, she worked as a law clerk for Justice Charles T. Canady at the Florida Supreme Court and Judge Richard J. Suarez at the Florida Third District Court of Appeal. As an active moot court member, she argued as a finalist in the Price International Media Law Moot Court Competition regional rounds in New York City and subsequently placed third in the international rounds at the University of Oxford in Oxford, United Kingdom. She also worked as a Certified Legal Intern in the FIU Immigrant Children's Justice Clinic, representing abused, abandoned, and neglected minors in dependency proceedings.

Ms. Abratt served as a Comments Editor for the FIU Law Review and earned three Book Awards, two for legal writing courses and one for a seminar on Intellectual Property and Human Rights. She was also awarded the Dean's Scholarship, Judge Aaron B. Cohen Externship Scholarship, and a full tuition scholarship from the Betty G. Michael Crist to Present Webinar on Formaldehyde Litigation

Michael Crist, a litigation partner with DLD Lawyers, will be presenting a Perrin Conferences Webinar on formaldehyde litigation, entitled, Formaldehyde – The Next Asbestos? Co-presenters include Brent Kerger (board certified toxicologist) and Patrick Sheehan (ecologist, toxicologist, and risk assessor) of Exponent. Together the presenters will outline new developments in formaldehyde litigation, regulation, exposure assessment, and toxicology. While the public commonly associates formaldehyde with museums and FEMA trailers, it is actually ubiquitous and has been described as the smell in new cars, homes, and furniture. With the public’s attention now turned to the off-gasing of Lumber Liquidators products and nail cosmetics, the scope of litigation is expected to grow dramatically. Michael Crist Successfuly Argued Asbestos Case Before Georgia Court of Appeals

Michael Crist, a litigation partner with DLD Lawyers, successfully argued a take-home asbestos case before the Georgia Court of Appeals. In an issue of first impression in Georgia, a mesothelioma Plaintiff sued both the manufacturer and distributor of a product that she had never worked with or around, but from which she claimed exposure through the work of her father. After conducting an extensive analysis of scientific, regulatory, and historical factors relevant to the state of the art and knowledge of the respective defendants, the Court concluded that there was no evidence that the distributor, as opposed to the manufacturer, knew, or should have known, of the potential dangers of asbestos to take-home plaintiffs during the relevant time frame. As such, it affirmed the motion for summary judgment provided to the distributor, represented by DLD, but overturned the one provided to the manufacturer. In so holding, the Appellate Court ruled that the Georgia Supreme Court case of CSX v Williams, 608 S.E. 2d 208 (Ga. 2005) did not apply to design defect cases. Jeanne Crandall Joins DLD Lawyers

She has tried to conclusion major jury and non-jury cases in federal and state courts, domestic and international arbitration cases, adversary proceedings in bankruptcy, and bank regulatory proceedings. She is the co-author of a Matthew-Bender treatise on antitrust law, and has published several articles on securities arbitration.

Patrick Gonyea to Speak at NAMWOLF 2013 Annual Meeting

Patrick Gonyea will be lecturing at this year’s Annual Meeting commencing on September 22, 2013. Mr. Gonyea and co-presenters, Beth Boggs of Boggs with Avellino, Lach & Boggs, LLC, Marcos Mendoza with Texas Association of School Boards Risk Management Fund and Gene Hou with American Family Insurance Group, will speak on the hot topic of firearm legislation and its effects for employers, employees businesses and the insurance industry. Donell Hicks Earns Board Certification in Construction Law

DLD Lawyers is proud to announce that Donell Hicks has earned the distinguished honor of board certification in construction law by the Florida Bar. Construction lawyers help resolve issues related to the design and construction of improvements on private and public projects.

Board certification recognizes an attorney's special knowledge, skills and proficiencies in various areas of law and professionalism and ethics in practice. This certification is the Bar's highest level of evaluation of a lawyer's competence and experience in a particular area of practice. Only attorneys who have earned The Florida Bar Board Certification are allowed to describe themselves as experts or specialists in a specific field of practice. Mr. Hicks is part of a select group composed of only 6% of Florida Bar members to obtain board certification. 

Mr. Hicks earned a bachelor of arts degree in government from Cornell University in 1997, and obtained his juris doctor degree from The George Washington University, in 2000. He is a member of The Maryland State Bar, the District of Columbia Bar, and the Florida Bar. Mr. Hicks' areas of focus include construction litigation, architectural and engineering malpractice, professional liability, insurance coverage/property & casualty, general & products liability, personal injury, directors & officers, and commercial litigation.

Frank Labrador: 2012 Enma Tarafa Legal Excellence Award Recipient

DLD Lawyers Donates $15k to HNBA Legal Education Fund

DLD Lawyers in support of national efforts to promote diversity in the workplace has donated $15,000 to the HNBA Legal Education Fund as part of its CHAMPION sponsorship of the 2012 HNBA Tennis & Golf Tournament. The Fund awards scholarships to hard working Hispanic students attending ABA-accredited law schools and provides financial assistance for “programs that address education and the law within the US Hispanic community and legal profession.”  This year’s Tournament will take place on Saturday, February 4, 2012 in Miami, Florida at the site of the Sony Ericsson Open, and the golf course next door. Gregory Victor to Speak at the 2012 CLM Alliance Conference

Gregory Victor, attorney at DLD Lawyers, has been selected to speak at the 2012 Annual Conference of the Claims and Litigation Management Alliance (CLM). Mr. Victor is slated to speak on the topic of improving the attorney-client relationship and meeting the client’s diversity and other corporate goals through an effective relationship partner.

Mr. Victor’s practice encompasses all aspects of the defense of property, casualty, personal injury insurance and general civil litigation matters in state and federal court. Mr. Victor has extensive trial experience in cases involving product liability, coverage disputes, bad faith, wrongful death, automobile, trucking, premises and commercial liability, negligent security, intentional torts, and property loss. Mr. Victor has served as a national and regional supervising and coordinating counsel for major insurance companies. He began his career as a prosecutor for the Dade County State Attorney’s office working under Janet Reno and is a former division chief and major crimes prosecutor. He is an “AV” rated attorney by Martindale-Hubbell Lawyers Directory.

The CLM conference will be one of the largest, fully inclusive defense industry conferences in 2012. It will be held March 28-30 in San Diego, California where more than 80 collaborative educational sessions featuring more than 300 speakers are scheduled and is expected to draw attendees from around the world.
